Counter-Notification Procedures
If you believe that material you posted was removed or access was disabled by mistake or misidentification, you may file a counter-notification with us under 17 U.S.C. § 512(g). Your counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the U.S., the judicial district in which Worldstimes.com is located), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.
Send the counter-notice to the same DMCA Agent contact information listed above. Upon receipt of a valid counter-notice, we may forward it to the original complainant. If the complainant does not file a lawsuit within 10-14 business days, we may, at our discretion, restore the removed material. This process ensures fairness while adhering to DMCA and Google AdSense standards.
Repeat Infringer Policy
In accordance with the DMCA and to maintain compliance with Google AdSense, Worldstimes.com has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also limit access to the site or terminate accounts of any users who infringe intellectual property rights, whether or not there is repeat infringement.
Misrepresentations and Liability
Any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability under Section 512(f) of the DMCA. Similarly, misrepresentations in counter-notifications may lead to legal consequences. We advise consulting an attorney before filing any notice or counter-notice.
